LEGAL STUFF

I retain all right to use artwork commissioned in personal or related business materials such as advertisements for future commissions, portfolio, sale at convention, etc.Private commissions are unavailable at this time.Art commissioned at the prices stated on this website are for PERSONAL USE ONLY. Using my artwork for commercial use without explicit permission will result in blacklisting and potential legal action if commercial use is not ceased. For Commercial inquiries, please email me at [email protected].Personal uses include but are not limited to:
-profile pictures
-individual's social media banners
-discord emoticons
-telegram stickers
-individual's stream decoration or embelishment
-supplementary artwork for use as character reference
-personal items such as printed badges, stickers made with the intent to hand out for free at gatherings, etc.Commercial uses include:
-Use in NFT or Block Chains**
-use in advertisement
-use in packaging for commercial products
-Reselling as physical products (posters, charms, shirts, etc)
-company logos
-company website embellishments**Use in block chains without prior consultation is strictly prohibited. A legal contract will be signed beforehand. Price for pieces intended for use in block chain are at minimum X5 The price of commissions sold with the intention of personal use. After each sale in the block chain i will receive 25% minimum of your Residuals. up to 50% for more elaborate pieces.

Payment and invoicing

All prices are in USD but can be charged in CAD equivilent upon request.I take payments for orders through paypal and square via invoice.
I can take payment from canadian clients through E-transfer on request.
YOU ARE NOT TO SEND COMMISSION PAYMENTS UNPROMPTED.Larger pieces totaling 300 USD or more may be paid in two installments (or more depending on the price) at request. The same rules will apply to these instances.I send an invoice once I am ready to start your commission, for larger pieces I will send a very rough gesture sketch before requesting payment. I have no obligation to work on pieces until initial payment has been made and you will not receive the full resolution file until I receive full payment.Core themes and expectations of the artwork are assumed to be agreed upon, at the time of receiving the invoice.
Major changes such as composition or thematic overhaul or additional characters not previously discussed will require additional payment. For more information, please read the Additional Fees and Discounts section below.

Additional Fees and Discounts

Large or otherwise intricate wings may be subject to a 15% increasecomplex designs (such as intricate clothing, markings or extreme anatomy) are subject to as high as a 25% fee.Intricate armors are subject to a 20-40% fee depending on the level of complexity.Commissions involving the artist, Boycub's, characters are subject to a 50% discount off of the additional character cost or a 40% discount on the commission total if all characters featured belong to the artist.Some commissions may qualify for additional discounts based on themes advertised at the time of the opening.Percentage increase will be calculated and applied separately to each applicable additional character on top of their individual "additional character" fee rather than to the subtotal of the full commission.
for example: if an artwork featuring 3 characters has 2 complex characters, only the 2 complex characters will have fees applied to them and the remaining character will be priced as normalAdditional character prices only apply to characters being in the same piece of artwork. Added characters are meant to be interacting or otherwise part of the same scene/themes/world.Multi-piece commissions will have each piece priced separately.Commissions can have reasonable alterations made as I work, however, after the sketch is confirmed and line art begins, requests that would require vast amounts of overhaul will be subject to fees or possible termination of your commission should the overhaul require vast amounts of work.Alterations to aspects such as pose or outfit are allowed as many times as needed, however, after the 2nd alteration and onward i may request further payment for my time.Minor edits like small color tweaks, missing character elements, major anatomical errors or missing elements originally agreed upon do not fall under this clause.

Completion Times

Commission times vary greatly depending on the level of artwork ordered ranging from several days to several months. Estimated completion times are as follows below but are just that: Estimations.Standard commission openings where 1-2 slots are accepted are generally completed within 2-3 weeks.Openings in which more than 2 full sized slots are taken are subject to a 4-8 week turnover.Badge commissions are typically taken 10 at a time, sorted into batches of 4-6 and done on a schedule in which each individual order is completed to subsequent stages simultaneously.
each batch runs on a 4 week timeline for digital completion.Large illustrations that include many characters or a fully detailed background may take multiple months to complete. These commissions are rarely accepted. Wait times have stretched as far as 24 months in the most extreme case.Wait times can also affected by circumstances such as commercial opportunities, conventions, illness, holidays and mental health.Any aggression from a client regarding my schedule including but not limited to: warmups, personal work, sketch streams for continuous income, convention preparation or other prior established responsibilities will be regarded as harassment. I pride myself on transparency and am more than happy to provide updates and guestimate timelines to those who ask.All standard commission types are guaranteed a sketch wip of your commission to make sure that you are happy with the base concept, as well as periodic updates unless explicitly declined.
wips for rough sketches, stream commissions, experimental commissions and adopt headshots are not guaranteed.You are welcome to pull out of queue up until i have finished the sketch stage and accepted payment, past there, you may only request partial refund depending on the stage and amount of time that i have spent on said commission. I retain the right to reuse any work on your piece that has been done up to that point at my own discretion unless otherwise agreed upon.

ADOPTABLES AND CUSTOM DESIGNS

Characters purchased from me either through pre-made adoptable sales or commissioned via custom design can be changed however the buyer sees fit. genitals, gender, colour, species, markings, etc.Prices advertised on this website and on my adoptable sales are intended for personal use, but have exceptions for individual artists and small art related businesses.Artists are allowed to sell any unique original artwork that they have created of the character without any additional rights needed (charms, prints, clothing, etc).Fursuit makers intending to use my designs for premade suit projects are not required to pay additional fees. informing me is greatly appreciated so I can follow along with the creation :)Companies or individuals purchasing with intent to use my designs for commercial video games, film, V-tubing, etc require consultation and may require additional fees.Characters purchased from me may be traded for other characters, traded for art, gifted or sold. Any complimentary art of the character made by me before or at the time of purchase does not count towards additional value unless commissioned through a separate transaction.Characters may not be traded, sold or gifted to people on my black list.Character designs by me found to be used in extreme portrayals of objectively harmful paraphilias or other morally concerning content may result in the offending party being added to my black list.
This is only done in extreme cases and would require malicious intent given how transparent i am about my boundaries.
EX: A character is bought and used to create explicit pedophilia, Bestiality works, etc that mirror real life harm for the expressed purpose of tittilation.If you have any questions, please ask.

NSFW COMMISSIONS

NSFW commissions are welcome so long as the client is 18+ and the characters requested are all 18+. Clients found to be of minor age will have their commission canceled and refunded.NSFW commissions found to be initiated through Intentional misdirection or misrepresentation of a character explicitly under legal age will be canceled and may not be refunded depending on the severity of the infraction.When commissioning NSFW pieces featuring the characters of multiple individuals, all parties must be consenting to the artwork being created.
